A challenge of legality and justiceFirst of all I would like to say that the New Municipal Water Regulation, or if you prefer the so-called "water agreement", is having a great success, both among families and among “non-users domestic” (commercial establishments, companies, professionals).
Even i large condominiums of Giugliano center and numerous people in the coastal area are adhering to the Administration's proposal. Many users run to lawyers at withdraw the appeals, and some large users, public companies and private, have already joined or are about to join.
We can say this is based on the numbers we have available: just under 3,000 arrived at citizens' homes deeds of membership accompanied by a letter from the Mayor and have already been issued subscribed over 1,000 less than ten rounds!!
Given the trend… we think, with due caution, this is a real success that rewards the big organizational effort for a battle of legality and justice.

Process standardization
We now have a complete picture of the entire water service situation: the users in total there are approximately 37,000; approximately 1/3 do not have a regular contract administration and water meter; 1/3 still has the water meter not working and the rest of the users have consumption water levels found in meter readings from 1998 to today, which exceed, in most cases, the sums proposed by the agreement. Therefore for them too, the Municipality's proposal is an opportunity not to be missed!
The effort of normalization of the service, search for illegal connections is still ongoing in progress: in fact the competent municipal offices, the Aqueduct Office, the Maintenance Office and the Financial Office together with the Anti-illegality Office they are doing a great job: we finally have a complete archive of users (with name and surname), have been found around 20,000 users who have never contributed to the water service including 5,000 non-resident users! The offices are also taking action to cross-reference the water databases with those of the municipal waste collection service in in such a way as to recover tax evaders also on the waste disposal front.

The “agreed water” represents the largest operation for the recovery of economic resources for the municipality of Giugliano... 47 million euros which will be used for create water infrastructures e sewerage, increase pressures, reduce losses, of which the city needs, and to strengthen the municipal budget.
I want highlight an important phenomenon: the first people who joined the agreed upon are those belonging to bands of the weakest population, elderly people and families in difficulty, who they told us that they were convinced by the fairness of the proposal, by the desire to close an old and degrading affair for this city. Yes they are complimented the Administration and encouraged us to continue this direction. We believe the city is giving a great lesson in civilization to those who are sad habit of criticizing any proposal and not believing in the honesty of our citizens and to all those who have the bad habit of not fulfilling one's civic duties.

Some general considerations
Before address the question of possible prescription I would like to make some considerations on the climate of recent months that has been created around the agreement water.
I would like to First of all, let's point out that every citizen of Giugliano knows well that, for about 15 years, there is a problem related to the collection of water fees and the poor quality of water and sewerage service. Every citizen knows from where the responsibilities come from, but he also knows that many users have taken advantage of the situation of anarchy where we found ourselves. The same ones citizens know well that the current Administration, the undersigned, as well as all the other people who gave us a hand in this battle of legality... they have no responsibility for the current state of disservices, nor for old bills, much less for poor water quality drinkable. I would also say that the Administration nor can it be accused of inertia or indifference towards the problem financial and to the problems of infrastructure deficiency. I say this because, as you know well, yes, even with water he can do politics (not charging for it) and the best way is to do nothing and leave the initiative to others. Each of you knows well that some cleverly he doesn't... he doesn't make mistakes
That said I would like to bring the matter back to right binaries: we are not a private company, nor a telephone company, much less a joint-stock company which needs profit to sustain itself of sales… we are not selling nothing. We did an operation on the contrary: we counted the debts, we verified, objectively average consumption per person, and we have spread this enormous financial hole equally on all users.
Allow me one question: but more public water than that what were we supposed to do? The Municipality pays the water to the Region, the citizens reimburse the Municipality. Nothing more. The alternative was to continue giving away the water and put the municipality in debt up to bring it to bankruptcy… I don't think you think this is governing good for current citizens and for future generations... I don't think this yes lasting and sustainable development.

The criticisms of these days on the walls of city
The attacks these days they seem to be those against insurance, or against telephone companies; it is the general principle that escapes those i who intend to destabilize the favorable climate created by thousands of registrations in recent days: the water agreement is simply an attempt to normalize the entire system, it is simply a response to all those, and I believe most, who they wanted everyone to contribute to paying, that they were not privileged, that meters were installed, that everyone had access to a “good water”, etc.

The prescription
I want to open again a small parenthesis before addressing the question of prescription. Who has written in these days of prescription talked about justice And truth. I would like to start right there. Sorry if I insist: but it is a fact that the water has been consumed. About 15 million meters cubes per year. Also in '98, '99 and 2000. I think this is a given certainly, indisputable and, I don't think, without the problems of water scarcity during the summer periods and to some particular situations, which the Municipality prevented the water supply to someone. So why get angry on the question of prescription And talk of justice when the resource has been consumed by all and when justice it should be to contribute to the expense of what has been consumed? So, if you believe in the principle we have followed, that is, to calculate i consumption based on averages of Italian consumption and by core components familiar, It's not this criterion anymore right than saying I don't pay because it is prescribed and therefore they will pay our children with a bankrupt municipality?
Let's come to appeals and the first few sentences available to us in the last few days:
1)    the cases are very varied but it can be traced back to three/four types:
a)     those who have neither the contract nor the meter;
b)    those who have a meter but it hasn't worked for years;
c)     who has a working meter but this is not possible go back to the initial reading of 1998;
d)    finally who has the contract, the working meter and the initial reading.
I think the cases should be treated differently, and the Administration is already studying the forms for appeal in ordinary courts to the sentences of the justices of the peace and for defend themselves from those who for years have used a service for free, often with illegal connections and hygienically not very recommendable.
We think that, with different degrees of responsibility from the first to the third category, ai pursuant to current laws and numerous rulings of the Court of Cassation, can be objected to by illegal theft of water enrichment, from the uninhabitability of houses not connected to drinking water pipes to contamination of water resource through unauthorized wells.
But it's not this the level of discussion, no Administration, in fact, much less the ours, wants to start proceedings judicial of mass towards the citizens, indeed the concordat represents own the will to want to heal in fair manner for all a situation outside the courtroom. Also having chosen not to defend oneself against the individual appellants but having Choosing a general solution represents proof of not wanting confrontation and the laceration of relations with citizens. However, unlike the Administrations that preceded us, we have chosen to recover the sums con un atto coraggioso di chiedere dei soldi ai cittadini per quanto consumato. And therefore, always following a principle of justice, we will also defend ourselves from those who will resort to justices of the peace with all weapons, civil and criminal, which an Administration can make use of.
Even the idea of flat rate calculation, although exceptions by some justices of the peace and some lawyers, still convinces us on the basis of justice and equity that underlies; so much so that there are sentences that say yes based on the principle of lump sum compensation when this is not possible objectively establish the amount of consumption not only for the service drinking water, but also for electricity.
Therefore the proposal of the Administration was to seek an agreement with the parties social, first, then with consumer associations and, finally, with citizens. The path was strongly shared.

But there is still a lot to do and I am there still some critical issues
First of all I would like to launch a call to strength policies, especially those of the center left, to help us in this battle for legality. We think we need to come together on issues which affect local finance but even more the civic sense of everyone us. And the water problem in Giugliano represents both issues.

Although they are many help desks have been activated, both at GESET and at the Municipality, the inconveniences persist and we are studying further forms of access to speed them up procedures and reduce waiting times we apologize to all citizens that these days, with great civility and responsibility, yes by going to the counters.

The documentation has not yet reached all homes because users are, as we said, over 37,000, but we have already installed approximately 4,000 new meters and we are already starting with the strengthening of the water and sewerage network and, from the 20th February, was launched, together with the ASL and ARIN, pursuant to the decree legislative n° 31 of 2003, a campaign of periodic measures to control the quality of the water by checking a series of chemical and bacteriological parameters.
In short, we are on the right track!
